  SECTION 943.0584. Criminal history records ineligible for court-ordered expunction or court-ordered sealing.

  • 1(1) 2As used in this section, the term “conviction” means a determination of guilt which is the result of a trial or the entry of a plea of guilty or nolo contendere, regardless of whether adjudication is withheld, or if the defendant was a minor, a finding that the defendant committed or pled guilty or nolo contendere to committing a delinquent act, regardless of whether adjudication of delinquency is withheld.
    71(2) 72A criminal history record is ineligible for a certificate of eligibility for expunction or a court-ordered expunction pursuant to s. 92943.0585 93or a certificate of eligibility for sealing or a court-ordered sealing pursuant to s. 107943.059 108if the record is a conviction for any of the following offenses:
    120(a) 121Sexual misconduct, as defined in s. 127393.135, 128s. 129394.4593, 130or s. 132916.1075;
    133(b) 134Illegal use of explosives, as defined in chapter 552;
    143(c) 144Terrorism, as defined in s. 149775.30;
    150(d) 151Murder, as defined in s. 156782.04, 157s. 158782.065, 159or s. 161782.09;
    162(e) 163Manslaughter or homicide, as defined in s. 170782.07, 171s. 172782.071, 173or s. 175782.072;
    176(f) 177Assault or battery, as defined in ss. 184784.011 185and 186784.03, 187respectively, of one family or household member by another family or household member, as defined in s. 204741.28(3);
    205(g) 206Aggravated assault, as defined in s. 212784.021;
    213(h) 214Felony battery, domestic battery by strangulation, or aggravated battery, as defined in ss. 227784.03, 228784.041, 229and 230784.045, 231respectively;
    232(i) 233Stalking or aggravated stalking, as defined in s. 241784.048;
    242(j) 243Luring or enticing a child, as defined in s. 252787.025;
    253(k) 254Human trafficking, as defined in s. 260787.06;
    261(l) 262Kidnapping or false imprisonment, as defined in s. 270787.01 271or s. 273787.02;
    274(m) 275Any offense defined in chapter 794;
    281(n) 282Procuring a person less than 18 years of age for prostitution, as defined in former s. 298796.03;
    299(o) 300Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age, as defined in s. 322800.04;
    323(p) 324Arson, as defined in s. 329806.01;
    330(q) 331Burglary of a dwelling, as defined in s. 339810.02;
    340(r) 341Voyeurism or video voyeurism, as defined in ss. 349810.14 350and 351810.145, 352respectively;
    353(s) 354Robbery or robbery by sudden snatching, as defined in ss. 364812.13 365and 366812.131, 367respectively;
    368(t) 369Carjacking, as defined in s. 374812.133;
    375(u) 376Home-invasion robbery, as defined in s. 382812.135;
    383(v) 384A violation of the Florida Communications Fraud Act, as provided in s. 396817.034;
    397(w) 398Abuse of an elderly person or disabled adult, or aggravated abuse of an elderly person or disabled adult, as defined in s. 420825.102;
    421(x) 422Lewd or lascivious offenses committed upon or in the presence of an elderly person or disabled person, as defined in s. 443825.1025;
    444(y) 445Child abuse or aggravated child abuse, as defined in s. 455827.03;
    456(z) 457Sexual performance by a child, as defined in s. 466827.071;
    467(aa) 468Any offense defined in chapter 839;
    474(bb) 475Certain acts in connection with obscenity, as defined in s. 485847.0133;
    486(cc) 487Any offense defined in s. 492847.0135;
    493(dd) 494Selling or buying of minors, as defined in s. 503847.0145;
    504(ee) 505Aircraft piracy, as defined in s. 511860.16;
    512(ff) 513Manufacturing a controlled substance in violation of chapter 893;
    522(gg) 523Drug trafficking, as defined in s. 529893.135; 530or
    531(hh) 532Any violation specified as a predicate offense for registration as a sexual predator pursuant to s. 548775.21, 549or sexual offender pursuant to s. 555943.0435, 556without regard to whether that offense alone is sufficient to require such registration.
