  SECTION 782.072. Vessel homicide.

  • 1“Vessel homicide” is the killing of a human being by the operation of a vessel as defined in s. 20327.02 21by another in a reckless manner likely to cause the death of, or great bodily harm to, another. Vessel homicide is:
    42(1) 43A felony of the second degree, punishable as provided in s. 54775.082, 55s. 56775.083, 57or s. 59775.08460.
    61(2) 62A felony of the first degree, punishable as provided in s. 73775.082, 74s. 75775.083, 76or s. 78775.084, 79if:
    80(a) 81At the time of the accident, the person knew, or should have known, that the accident occurred; and
    99(b) 100The person failed to give information and render aid as required by s. 113327.30(1)114.

    115This subsection does not require that the person knew that the accident resulted in injury or death.
