  SECTION 914.22. Tampering with or harassing a witness, victim, or informant; penalties.

  • 1(1) 2A person who knowingly uses intimidation or physical force, or threatens another person, or attempts to do so, or engages in misleading conduct toward another person, or offers pecuniary benefit or gain to another person, with intent to cause or induce any person to:
    46(a) 47Withhold testimony, or withhold a record, document, or other object, from an official investigation or official proceeding;
    64(b) 65Alter, destroy, mutilate, or conceal an object with intent to impair the integrity or availability of the object for use in an official investigation or official proceeding;
    92(c) 93Evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official investigation or an official proceeding;
    121(d) 122Be absent from an official proceeding to which such person has been summoned by legal process;
    138(e) 139Hinder, delay, or prevent the communication to a law enforcement officer or judge of information relating to the commission or possible commission of an offense or a violation of a condition of probation, parole, or release pending a judicial proceeding; or
    180(f) 181Testify untruthfully in an official investigation or an official proceeding,

    191commits the crime of tampering with a witness, victim, or informant.

    202(2) 203Tampering with a witness, victim, or informant is a:
    212(a) 213Felony of the third degree, punishable as provided in s. 223775.082, 224s. 225775.083, 226or s. 228775.084, 229where the official investigation or official proceeding affected involves the investigation or prosecution of a misdemeanor.
    245(b) 246Felony of the second degree, punishable as provided in s. 256775.082, 257s. 258775.083, 259or s. 261775.084, 262where the official investigation or official proceeding affected involves the investigation or prosecution of a third degree felony.
    280(c) 281Felony of the first degree, punishable as provided in s. 291775.082, 292s. 293775.083, 294or s. 296775.084, 297where the official investigation or official proceeding affected involves the investigation or prosecution of a second degree felony.
    315(d) 316Felony of the first degree, punishable by a term of years not exceeding life or as provided in s. 335775.082, 336s. 337775.083, 338or s. 340775.084, 341where the official investigation or official proceeding affected involves the investigation or prosecution of a first degree felony or a first degree felony punishable by a term of years not exceeding life.
    373(e) 374Life felony, punishable as provided in s. 381775.082, 382s. 383775.083, 384or s. 386775.084, 387where the official investigation or official proceeding affected involves the investigation or prosecution of a life or capital felony.
    406(f) 407Felony of the third degree, punishable as provided in s. 417775.082, 418s. 419775.083, 420or s. 422775.084, 423where the offense level of the affected official investigation or official proceeding is indeterminable or where the affected official investigation or official proceeding involves a noncriminal investigation or proceeding.
    452(3) 453Whoever intentionally harasses another person and thereby hinders, delays, prevents, or dissuades any person from:
    468(a) 469Attending or testifying in an official proceeding or cooperating in an official investigation;
    482(b) 483Reporting to a law enforcement officer or judge the commission or possible commission of an offense or a violation of a condition of probation, parole, or release pending a judicial proceeding;
    514(c) 515Arresting or seeking the arrest of another person in connection with an offense; or
    529(d) 530Causing a criminal prosecution, or a parole or probation revocation proceeding, to be sought or instituted, or from assisting in such prosecution or proceeding;

    554or attempts to do so, commits the crime of harassing a witness, victim, or informant.

    569(4) 570Harassing a witness, victim, or informant is a:
    578(a) 579Misdemeanor of the first degree, punishable as provided in s. 589775.082 590or s. 592775.083, 593where the official investigation or official proceeding affected involves the investigation or prosecution of a misdemeanor.
    609(b) 610Felony of the third degree, punishable as provided in s. 620775.082, 621s. 622775.083, 623or s. 625775.084, 626where the official investigation or official proceeding affected involves the investigation or prosecution of a third degree felony.
    644(c) 645Felony of the second degree, punishable as provided in s. 655775.082, 656s. 657775.083, 658or s. 660775.084, 661where the official investigation or official proceeding affected involves the investigation or prosecution of a second degree felony.
    679(d) 680Felony of the first degree, punishable as provided in s. 690775.082, 691s. 692775.083, 693or s. 695775.084, 696where the official investigation or official proceeding affected involves the investigation or prosecution of a first degree felony.
    714(e) 715Felony of the first degree, punishable by a term of years not exceeding life or as provided in s. 734775.082, 735s. 736775.083, 737or s. 739775.084, 740where the official investigation or official proceeding affected involves the investigation or prosecution of a felony of the first degree punishable by a term of years not exceeding life or a prosecution of a life or capital felony.
    778(f) 779Felony of the third degree, punishable as provided in s. 789775.082, 790s. 791775.083, 792or s. 794775.084, 795where the offense level of the affected official investigation or official proceeding is indeterminable or where the affected official investigation or official proceeding involves a noncriminal investigation or proceeding.
    824(5) 825For the purposes of this section:
    831(a) 832An official proceeding need not be pending or about to be instituted at the time of the offense; and
    851(b) 852The testimony or the record, document, or other object need not be admissible in evidence or free of a claim of privilege.
    874(6) 875In a prosecution for an offense under this section, no state of mind need be proved with respect to the circumstance:
    896(a) 897That the official proceeding before a judge, court, grand jury, or government agency is before a judge or court of the state, a state or local grand jury, or a state agency; or
    930(b) 931That the judge is a judge of the state or that the law enforcement officer is an officer or employee of the state or a person authorized to act for or on behalf of the state or serving the state as an adviser or consultant.
