  SECTION 775.32. Use of military-type training provided by a designated foreign terrorist organization.

  • 1(1) 2As used in this section, the term:
    9(a) 10“Critical infrastructure facility” has the same meaning as provided in s. 21493.63122.
    23(b) 24“Designated foreign terrorist organization” means an organization designated as a terrorist organization under s. 219 of the Immigration and Nationality Act.
    45(c) 46“Military-type training” means training:
    501. 51In means or methods that can:
    57a. 58Cause the death of, or serious bodily injury to, another person;
    69b. 70Destroy or damage property; or
    75c. 76Disrupt services to a critical infrastructure facility; or
    842. 85On the use, storage, production, or assembly of an explosive, a firearm, or any other weapon, including a weapon of mass destruction.
    107(d) 108“Serious bodily injury” has the same meaning as provided in s. 119775.30(3)120.
    121(e) 122“Weapon of mass destruction” has the same meaning as provided in s. 134790.166135.
    136(2) 137A person who has received military-type training from a designated foreign terrorist organization may not use, attempt to use, or conspire to use such military-type training with the intent to unlawfully harm another person or damage a critical infrastructure facility.
    177(3) 178A person who commits a violation of subsection (2) commits a felony of the second degree, punishable as provided in s. 199775.082, 200s. 201775.083, 202or s. 204775.084205.
    206(4) 207A person who commits a violation of subsection (2) which results in the death of, or serious bodily injury to, a person commits a felony of the first degree, punishable as provided in s. 241775.082, 242s. 243775.083, 244or s. 246775.084247.
