  SECTION 874.05. Causing, encouraging, soliciting, or recruiting criminal gang membership.

  • 1(1)(a) 2Except as provided in paragraph (b), a person who intentionally causes, encourages, solicits, or recruits another person to become a criminal gang member where a condition of membership or continued membership is the commission of any crime commits a felony of the third degree, punishable as provided in s. 51775.082, 52s. 53775.083, 54or s. 56775.08457.
    58(b) 59A person who commits a second or subsequent violation of this subsection commits a felony of the second degree, punishable as provided in s. 83775.082, 84s. 85775.083, 86or s. 88775.08489.
    90(2)(a) 91Except as provided in paragraph (b), a person who intentionally causes, encourages, solicits, or recruits another person under 13 years of age to become a criminal gang member where a condition of membership or continued membership is the commission of any crime commits a felony of the second degree, punishable as provided in s. 145775.082, 146s. 147775.083, 148or s. 150775.084151.
    152(b) 153A person who commits a second or subsequent violation of this subsection commits a felony of the first degree, punishable as provided in s. 177775.082, 178s. 179775.083, 180or s. 182775.084183.
