  SECTION 836.12. Threats.

  • 1(1) 2As used in this section, the term:
    9(a) 10“Family member” means:
    131. 14An individual related to another individual by blood or marriage; or
    252. 26An individual who stands in loco parentis to another individual.
    36(b) 37“Law enforcement officer” means:
    411. 42A law enforcement officer as defined in s. 50943.10; 51or
    522. 53A federal law enforcement officer as defined in s. 62901.150563.
    64(2) 65Any person who threatens a law enforcement officer, a state attorney, an assistant state attorney, a firefighter, a judge, or an elected official, or a family member of such persons, with death or serious bodily harm commits a misdemeanor of the first degree, punishable as provided in s. 113775.082 114or s. 116775.083117.
    118(3) 119A person who commits a second or subsequent violation of subsection (2) commits a felony of the third degree, punishable as provided in s. 143775.082, 144s. 145775.083, 146or s. 148775.084149.
