  SECTION 775.0823. Violent offenses committed against law enforcement officers, correctional officers, state attorneys, assistant state attorneys, justices, or judges.

  • 1The Legislature does hereby provide for an increase and certainty of penalty for any person convicted of a violent offense against any law enforcement or correctional officer, as defined in s. 32943.10(1), 33(2), (3), (6), (7), (8), or (9); against any state attorney elected pursuant to s. 4827.01 49or assistant state attorney appointed under s. 5627.181; 57or against any justice or judge of a court described in Art. V of the State Constitution, which offense arises out of or in the scope of the officer’s duty as a law enforcement or correctional officer, the state attorney’s or assistant state attorney’s duty as a prosecutor or investigator, or the justice’s or judge’s duty as a judicial officer, as follows:
    119(1) 120For murder in the first degree as described in s. 130782.04(1), 131if the death sentence is not imposed, a sentence of imprisonment for life without eligibility for release.
    148(2) 149For attempted murder in the first degree as described in s. 160782.04(1), 161a sentence pursuant to s. 166775.082, 167s. 168775.083, 169or s. 171775.084172.
    173(3) 174For attempted felony murder as described in s. 182782.051, 183a sentence pursuant to s. 188775.082, 189s. 190775.083, 191or s. 193775.084194.
    195(4) 196For murder in the second degree as described in s. 206782.04(2) 207and (3), a sentence pursuant to s. 214775.082, 215s. 216775.083, 217or s. 219775.084220.
    221(5) 222For attempted murder in the second degree as described in s. 233782.04(2) 234and (3), a sentence pursuant to s. 241775.082, 242s. 243775.083, 244or s. 246775.084247.
    248(6) 249For murder in the third degree as described in s. 259782.04(4), 260a sentence pursuant to s. 265775.082, 266s. 267775.083, 268or s. 270775.084271.
    272(7) 273For attempted murder in the third degree as described in s. 284782.04(4), 285a sentence pursuant to s. 290775.082, 291s. 292775.083, 293or s. 295775.084296.
    297(8) 298For manslaughter as described in s. 304782.07 305during the commission of a crime, a sentence pursuant to s. 316775.082, 317s. 318775.083, 319or s. 321775.084322.
    323(9) 324For kidnapping as described in s. 330787.01, 331a sentence pursuant to s. 336775.082, 337s. 338775.083, 339or s. 341775.084342.
    343(10) 344For aggravated battery as described in s. 351784.045, 352a sentence pursuant to s. 357775.082, 358s. 359775.083, 360or s. 362775.084363.
    364(11) 365For aggravated assault as described in s. 372784.021, 373a sentence pursuant to s. 378775.082, 379s. 380775.083, 381or s. 383775.084384.

    385Notwithstanding the provisions of s. 390948.01, 391with respect to any person who is found to have violated this section, adjudication of guilt or imposition of sentence shall not be suspended, deferred, or withheld.
