  SECTION 682.10. Change of award by arbitrators.

  • 1(1) 2On motion to an arbitrator by a party to an arbitration proceeding, the arbitrator may modify or correct an award:
    22(a) 23Upon a ground stated in s. 29682.14(1)(a) 30or (c);
    32(b) 33Because the arbitrator has not made a final and definite award upon a claim submitted by the parties to the arbitration proceeding; or
    56(c) 57To clarify the award.
    61(2) 62A motion under subsection (1) must be made and notice given to all parties within 20 days after the movant receives notice of the award.
    87(3) 88A party to the arbitration proceeding must give notice of any objection to the motion within 10 days after receipt of the notice.
    111(4) 112If a motion to the court is pending under s. 122682.12, 123s. 124682.13, 125or s. 127682.14, 128the court may submit the claim to the arbitrator to consider whether to modify or correct the award:
    146(a) 147Upon a ground stated in s. 153682.14(1)(a) 154or (c);
    156(b) 157Because the arbitrator has not made a final and definite award upon a claim submitted by the parties to the arbitration proceeding; or
    180(c) 181To clarify the award.
    185(5) 186An award modified or corrected pursuant to this section is subject to ss. 199682.09(1), 200682.12, 201682.13, 202and 203682.14204.
