SECTION 496.417. Criminal penalties.

1Except as otherwise provided in ss. 7496.4018-9496.424, 10and in addition to any administrative or civil penalties, any person who willfully and knowingly violates ss. 27496.40128-29496.424 30commits a felony of the third degree, punishable as provided in s. 42775.082, 43s. 44775.083, 45or s. 47775.08448. For a second or subsequent conviction, such violation constitutes a felony of the second degree, punishable as provided in s. 69775.082, 70s. 71775.083, 72or s. 74775.08475.
