  SECTION 458.303. Provisions not applicable to other practitioners; exceptions, etc.

  • 1(1) 2The provisions of ss. 6458.301, 7458.305, 8458.307, 9458.309, 10458.311, 11458.313, 12458.315, 13458.317, 14458.319, 15458.321, 16458.327, 17458.329, 18458.331, 19458.337, 20458.339, 21458.341, 22458.343, 23458.345, 24458.347, 25and this section shall have no application to:
    33(a) 34Other duly licensed health care practitioners acting within their scope of practice authorized by statute.
    49(b) 50Any physician lawfully licensed in another state or territory or foreign country, when meeting duly licensed physicians of this state in consultation.
    72(c) 73Commissioned medical officers of the Armed Forces of the United States and of the Public Health Service of the United States while on active duty and while acting within the scope of their military or public health responsibilities.
    111(d) 112Any person while actually serving without salary or professional fees on the resident medical staff of a hospital in this state, subject to the provisions of s. 139458.321140.
    141(e) 142Any person furnishing medical assistance in case of an emergency.
    152(f) 153The domestic administration of recognized family remedies.
    160(g) 161The practice of the religious tenets of any church in this state.
    173(h) 174Any person or manufacturer who, without the use of drugs or medicine, mechanically fits or sells lenses, artificial eyes or limbs, or other apparatus or appliances or is engaged in the mechanical examination of eyes for the purpose of constructing or adjusting spectacles, eyeglasses, or lenses.
    220(2) 221Nothing in s. 224458.301, 225s. 226458.305, 227s. 228458.307, 229s. 230458.309, 231s. 232458.311, 233s. 234458.313, 235s. 236458.319, 237s. 238458.321, 239s. 240458.327, 241s. 242458.329, 243s. 244458.331, 245s. 246458.337, 247s. 248458.339, 249s. 250458.341, 251s. 252458.343, 253s. 254458.345, 255s. 256458.347, 257or this section shall be construed to prohibit any service rendered by a registered nurse or a licensed practical nurse, if such service is rendered under the direct supervision and control of a licensed physician who provides specific direction for any service to be performed and gives final approval to all services performed. Further, nothing in this or any other chapter shall be construed to prohibit any service rendered by a medical assistant in accordance with the provisions of s. 337458.3485338.
