  SECTION 401.41. Penalties.

  • 1(1) 2Any person who:
    5(a) 6Uses or attempts to use a certificate, license, or permit that has been suspended, revoked, or terminated;
    23(b) 24Practices or holds himself or herself out as an emergency medical technician, paramedic, or ambulance driver without being so certified;
    44(c) 45Knowingly conceals information relating to violations of this part; or
    55(d) 56Knowingly makes false or fraudulent claims to procure, attempt to procure, or renew a certificate, license, or permit

    74is guilty of a misdemeanor of the first degree, punishable as provided in s. 88775.082 89or s. 91775.08392.

    93(2) 94Whoever willfully and with intent to defraud obtains or attempts to obtain services from a licensee is guilty of:
    113(a) 114A misdemeanor of the second degree, punishable as provided in s. 125775.082 126or s. 128775.083, 129for the first offense; and
    134(b) 135A misdemeanor of the first degree, punishable as provided in s. 146775.082 147or s. 149775.083, 150for any subsequent offense.
    154(3) 155Whoever summons any emergency medical services vehicle pursuant to this part or reports that an emergency medical services vehicle is needed when he or she knows or has reason to know that the services of the vehicle are not needed is guilty of:
    198(a) 199A misdemeanor of the second degree, punishable as provided in s. 210775.082 211or s. 213775.083, 214for the first offense; and
    219(b) 220A misdemeanor of the first degree, punishable as provided in s. 231775.082 232or s. 234775.083, 235for any subsequent offense.
    239(4) 240Each day that a violation of this part is committed or permitted to continue constitutes a separate and distinct offense under this section.
