  SECTION 934.21. Unlawful access to stored communications; penalties.

  • 1(1) 2Except as provided in subsection (3), whoever:
    9(a) 10Intentionally accesses without authorization a facility through which an electronic communication service is provided, or
    25(b) 26Intentionally exceeds an authorization to access such facility,

    34and thereby obtains, alters, or prevents authorized access to a wire or electronic communication while it is in electronic storage in such system shall be punished as provided in subsection (2).

    65(2) 66The punishment for an offense under subsection (1) is as follows:
    77(a) 78If the offense is committed for purposes of commercial advantage, malicious destruction or damage, or private commercial gain, the person is:
    991. 100In the case of a first offense under this subsection, guilty of a misdemeanor of the first degree, punishable as provided in s. 123775.082, 124s. 125775.083, 126or s. 128934.41129.
    1302. 131In the case of any subsequent offense under this subsection, guilty of a felony of the third degree, punishable as provided in s. 154775.082, 155s. 156775.083, 157s. 158775.084, 159or s. 161934.41162.
    163(b) 164In any other case, the person is guilty of a misdemeanor of the second degree, punishable as provided in s. 184775.082 185or s. 187775.083188.
    189(3) 190Subsection (1) does not apply with respect to conduct authorized:
    200(a) 201By the person or entity providing a wire or electronic communications service;
    213(b) 214By a user of a wire or electronic communications service with respect to a communication of or intended for that user; or
    236(c) 237In s. 239934.09, 240s. 241934.23, 242or s. 244934.24245.
