  SECTION 893.147. Use, possession, manufacture, delivery, transportation, advertisement, or retail sale of drug paraphernalia, specified machines, and materials.

  • 1(1) 2USE OR POSSESSION OF DRUG PARAPHERNALIA.8-9It is unlawful for any person to use, or to possess with intent to use, drug paraphernalia:
    26(a) 27To plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, or conceal a controlled substance in violation of this chapter; or
    56(b) 57To inject, ingest, inhale, or otherwise introduce into the human body a controlled substance in violation of this chapter.

    76Any person who violates this subsection is guilty of a misdemeanor of the first degree, punishable as provided in s. 96775.082 97or s. 99775.083100.

    101(2) 102MANUFACTURE OR DELIVERY OF DRUG PARAPHERNALIA.108-109It is unlawful for any person to deliver, possess with intent to deliver, or manufacture with intent to deliver drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used:
    144(a) 145To plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, or conceal a controlled substance in violation of this act; or
    174(b) 175To inject, ingest, inhale, or otherwise introduce into the human body a controlled substance in violation of this act.

    194Any person who violates this subsection is guilty of a felony of the third degree, punishable as provided in s. 214775.082, 215s. 216775.083, 217or s. 219775.084220.

    221(3) 222DELIVERY OF DRUG PARAPHERNALIA TO A MINOR.229-
    230(a) 231Any person 18 years of age or over who violates subsection (2) by delivering drug paraphernalia to a person under 18 years of age is guilty of a felony of the second degree, punishable as provided in s. 269775.082, 270s. 271775.083, 272or s. 274775.084275.
    276(b) 277It is unlawful for any person to sell or otherwise deliver hypodermic syringes, needles, or other objects which may be used, are intended for use, or are designed for use in parenterally injecting substances into the human body to any person under 18 years of age, except that hypodermic syringes, needles, or other such objects may be lawfully dispensed to a person under 18 years of age by a licensed practitioner, parent, or legal guardian or by a pharmacist pursuant to a valid prescription for same. Any person who violates the provisions of this paragraph is guilty of a misdemeanor of the first degree, punishable as provided in s. 386775.082 387or s. 389775.083390.
    391(4) 392TRANSPORTATION OF DRUG PARAPHERNALIA.396-397It is unlawful to use, possess with the intent to use, or manufacture with the intent to use drug paraphernalia, knowing or under circumstances in which one reasonably should know that it will be used to transport:
    434(a) 435A controlled substance in violation of this chapter; or
    444(b) 445Contraband as defined in s. 450932.701(2)(a)1451.

    452Any person who violates this subsection commits a felony of the third degree, punishable as provided in s. 470775.082, 471s. 472775.083, 473or s. 475775.084476.

    477(5) 478ADVERTISEMENT OF DRUG PARAPHERNALIA.482-483It is unlawful for any person to place in any newspaper, magazine, handbill, or other publication any advertisement, knowing, or under circumstances where one reasonably should know, that the purpose of the advertisement, in whole or in part, is to promote the sale of objects designed or intended for use as drug paraphernalia. Any person who violates this subsection is guilty of a misdemeanor of the first degree, punishable as provided in s. 556775.082 557or s. 559775.083560.
    561(6) 562RETAIL SALE OF DRUG PARAPHERNALIA.567-
    568(a) 569It is unlawful for a person to knowingly and willfully sell or offer for sale at retail any drug paraphernalia described in s. 592893.145(12)(a)593-(c) or (g)-(m), other than a pipe that is primarily made of briar, meerschaum, clay, or corn cob.
    611(b) 612A person who violates paragraph (a) commits a misdemeanor of the first degree, punishable as provided in s. 630775.082 631or s. 633775.083, 634and, upon a second or subsequent violation, commits a felony of the third degree, punishable as provided in s. 653775.082, 654s. 655775.083, 656or s. 658775.084659.
    660(7) 661TABLETING MACHINES, ENCAPSULATING MACHINES, AND CONTROLLED SUBSTANCE COUNTERFEITING MATERIALS.670-
    671(a) 672Except as provided in paragraph (b), it is unlawful for any person to possess, purchase, deliver, sell, or possess with intent to sell or deliver a tableting machine, an encapsulating machine, or controlled substance counterfeiting materials knowing, intending, or having reasonable cause to believe that it will be used to manufacture a controlled substance or counterfeit controlled substance.
    730(b)1. 731A regulated person may possess, purchase, deliver, sell, or possess with intent to deliver or sell a tableting machine or encapsulating machine as part of a regulated transaction with a regular customer or regular importer if he or she is in compliance with 21 U.S.C. s. 830. For purposes of this paragraph, the terms “regulated person,” “regulated transaction,” “regular customer,” and “regular importer” have the same meanings as provided in 21 U.S.C. s. 802.
    8082. 809A person registered under 21 U.S.C. s. 822 may possess, purchase, deliver, sell, or possess with intent to deliver or sell a tableting machine or encapsulating machine to manufacture a controlled substance pursuant to such registration.
    8453. 846A person who holds an active, unencumbered license or a permit under s. 859381.986 860or chapter 465 may possess, purchase, deliver, sell, or possess with intent to sell or deliver a tableting machine or encapsulating machine to manufacture a controlled substance, if such person is performing functions in compliance with or under the authority of that license or permit.
    905(c) 906For purposes of this subsection, the term:
    9131. 914“Controlled substance” has the same meaning as provided in s. 924893.02(4)925.
    9262. 927“Controlled substance counterfeiting material” means a punch, die, plate, stone, or other item designed to print, imprint, or reproduce the trademark, trade name, or other identifying mark, imprint, or device of another or any likeness of any of the foregoing upon a drug or container or labeling thereof so as to render such drug a counterfeit controlled substance.
    9853. 986“Counterfeit controlled substance” has the same meaning as provided in s. 997831.31(2)998.
    9994. 1000“Encapsulating machine” means manual, semiautomatic, or fully automatic equipment that can be used to fill shells or capsules with powdered or granular solids or semisolid material to produce coherent solid tablets.
    10315. 1032“Tableting machine” means manual, semiautomatic, or fully automatic equipment that can be used to compact or mold powdered or granular solids or semisolid material to produce coherent solid tablets.
    1061(d)1. 1062Except as provided in subparagraph 2., a person who violates this subsection commits a felony of the third degree, punishable as provided in s. 1086775.082, 1087s. 1088775.083, 1089or s. 1091775.0841092.
    10932. 1094Any person who violates this subsection knowing, intending, or having reasonable cause to believe that such action will result in the unlawful manufacture of a controlled substance or counterfeit controlled substance that contains:
    1127a. 1128A substance controlled under s. 1133893.03(1);
    1134b. 1135Cocaine, as described in s. 1140893.03(2)(a)41141.;
    1142c. 1143Opium or any synthetic or natural salt, compound, derivative, or preparation of opium;
    1156d. 1157Methadone;
    1158e. 1159Alfentanil, as described in s. 1164893.03(2)(b)11165.;
    1166f. 1167Carfentanil, as described in s. 1172893.03(2)(b)61173.;
    1174g. 1175Fentanyl, as described in s. 1180893.03(2)(b)91181.;
    1182h. 1183Sufentanil, as described in s. 1188893.03(2)(b)301189.; or
    1191i. 1192A controlled substance analog, as described in s. 1200893.0356, 1201of any substance specified in sub-subparagraphs a.-h.,

    1208commits a felony of the second degree, punishable as provided in s. 1220775.082, 1221s. 1222775.083, 1223or s. 1225775.0841226.
