  SECTION 88.7041. Initiation by Department of Revenue of support proceeding under convention.

  • 1(1) 2In a support proceeding under this part, the Department of Revenue shall:
    14(a) 15Transmit and receive applications; and
    20(b) 21Initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.
    38(2) 39The following support proceedings are available to an obligee under the convention:
    51(a) 52Recognition or recognition and enforcement of a foreign support order.
    62(b) 63Enforcement of a support order issued or recognized in this state.
    74(c) 75Establishment of a support order if there is no existing order, including, where necessary, determination of parentage of a child.
    95(d) 96Establishment of a support order if recognition of a foreign support order is refused under s. 11288.7081(2)(b), 113(d), or (i).
    116(e) 117Modification of a support order of a tribunal of this state.
    128(f) 129Modification of a support order of a tribunal of another state or a foreign country.
    144(3) 145The following support proceedings are available under the convention to an obligor against whom there is an existing support order:
    165(a) 166Recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state.
    185(b) 186Modification of a support order of a tribunal of this state.
    197(c) 198Modification of a support order of a tribunal of another state or foreign country.
    212(4) 213A tribunal of this state may not require security, bond, or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the convention.
