  SECTION 860.121. Crimes against railroad vehicles; penalties.

  • 1(1) 2It shall be unlawful for any person to shoot at, throw any object capable of causing death or great bodily harm at, or place any object capable of causing death or great bodily harm in the path of any railroad train, locomotive, car, caboose, or other railroad vehicle.
    50(2)(a) 51Any person who violates subsection (1) with respect to an unoccupied railroad vehicle is guilty of a felony of the third degree, punishable as provided in s. 78775.082, 79s. 80775.083, 81or s. 83775.08484.
    85(b) 86Any person who violates subsection (1) with respect to an occupied railroad vehicle or a railroad vehicle connected thereto is guilty of a felony of the second degree, punishable as provided in s. 119775.082, 120s. 121775.083, 122or s. 124775.084125.
    126(c) 127Any person who violates subsection (1), if such violation results in great bodily harm, is guilty of a felony of the first degree, punishable as provided in s. 155775.082, 156s. 157775.083, 158or s. 160775.084161.
    162(d) 163Any person who violates subsection (1), if such violation results in death, is guilty of homicide as defined in chapter 782, punishable as provided in s. 189775.082190.
