  SECTION 831.30. Medicinal drugs; fraud in obtaining.

  • 1Whoever:
    2(1) 3Falsely makes, alters, or forges any prescription, as defined in s. 14465.003, 15for a medicinal drug other than a drug controlled by chapter 893;
    27(2) 28Knowingly causes such prescription to be falsely made, altered, forged, or counterfeited; or
    41(3) 42Passes, utters, or publishes such prescription or otherwise knowingly holds out such false or forged prescription as true

    60with intent to obtain such drug commits a misdemeanor of the second degree, punishable as provided in s. 78775.082 79or s. 81775.08382. A second or subsequent conviction constitutes a misdemeanor of the first degree, punishable as provided in s. 100775.082 101or s. 103775.083104.
