  SECTION 823.09. Violation of s. 823.07; penalty.

  • 1Any person violating any provision of s. 8823.07, 9is guilty of a misdemeanor of the second degree, punishable as provided in s. 23775.082 24or s. 26775.083; 27provided, however, that in the event death of a minor child or permanent physical or mental injury to a minor child results from willful and wanton misconduct amounting to culpable negligence on the part of the person committing such violation, then such person shall be guilty of a felony of the third degree, punishable as provided in s. 85775.082, 86s. 87775.083, 88or s. 90775.08491.
