  SECTION 775.0861. Offenses against persons on the grounds of religious institutions; reclassification.

  • 1(1) 2For purposes of this section, the term:
    9(a) 10“Religious institution” is as defined in s. 17496.40418.
    19(b) 20“Religious service” is a religious ceremony, prayer, or other activity according to a form and order prescribed for worship, including a service related to a particular occasion.
    47(2) 48The felony or misdemeanor degree of any violation of:
    57(a) 58Section 59784.011, 60relating to assault;
    63(b) 64Section 65784.021, 66relating to aggravated assault;
    70(c) 71Section 72784.03, 73relating to battery;
    76(d) 77Section 78784.041, 79relating to felony battery;
    83(e) 84A statute defining any offense listed in s. 92775.084(1)(b)193.; or
    95(f) 96Any other statute defining an offense that involves the use or threat of physical force or violence against any individual

    116shall be reclassified as provided in this section if the offense is committed on the property of a religious institution while the victim is on the property for the purpose of participating in or attending a religious service.

    154(3)(a) 155In the case of a misdemeanor of the second degree, the offense is reclassified to a misdemeanor of the first degree.
    176(b) 177In the case of a misdemeanor of the first degree, the offense is reclassified to a felony of the third degree. For purposes of sentencing under chapter 921, such offense is ranked in level 2 of the offense severity ranking chart.
    218(c) 219In the case of a felony of the third degree, the offense is reclassified to a felony of the second degree.
    240(d) 241In the case of a felony of the second degree, the offense is reclassified to a felony of the first degree.
    262(e) 263In the case of a felony of the first degree, the offense is reclassified to a life felony.

    281For purposes of sentencing under chapter 921 and determining incentive gain-time eligibility under chapter 944, a felony offense that is reclassified under this subsection is ranked one level above the ranking under s. 314921.0022 315or s. 317921.0023 318of the offense committed.
