  SECTION 732.221. Perfection of title of personal representative or beneficiary.

  • 1If the title to any property to which ss. 10732.21611-12732.228 13apply is held by the surviving spouse at the time of the decedent’s death, the personal representative or a beneficiary of the decedent may institute an action to perfect title to the property. The personal representative has no duty to discover whether any property held by the surviving spouse is property to which ss. 67732.21668-69732.228 70apply, unless a written demand is made by a beneficiary within 3 months after service of a copy of the notice of administration on the beneficiary or by a creditor within 3 months after the first publication of the notice to creditors.
