  SECTION 719.616. Disclosure of condition of building and estimated replacement costs.

  • 1(1) 2Each developer of a residential cooperative created by converting existing, previously occupied improvements to such form of ownership shall disclose the condition of the improvements and the condition of certain components and their current estimated replacement costs.
    39(2) 40The following information shall be stated concerning the improvements:
    49(a) 50The date and type of construction.
    56(b) 57The prior use.
    60(c) 61Whether there is termite damage or infestation and whether the termite damage or infestation, if any, has been properly treated. The statement shall be substantiated by including, as an exhibit, an inspection report by a certified pest control operator.
    100(3)(a) 101Disclosure of condition shall be made for each of the following components that the existing improvements may include:
    1191. 120Roof.
    1212. 122Structure.
    1233. 124Fireproofing and fire protection systems.
    1294. 130Elevators.
    1315. 132Heating and cooling systems.
    1366. 137Plumbing.
    1387. 139Electrical systems.
    1418. 142Swimming pool.
    1449. 145Seawalls.
    14610. 147Pavement and parking areas.
    15111. 152Drainage systems.
    154(b) 155For each component, the following information shall be disclosed and substantiated by attaching a copy of a certificate under seal of an architect or engineer authorized to practice in this state:
    1861. 187The age of the component.
    1922. 193The estimated remaining useful life of the component.
    2013. 202The estimated current replacement cost of the component, expressed:
    211a. 212As a total amount, and
    217b. 218As a per unit amount, based upon each unit’s proportional share of the common expenses.
    2334. 234The structural and functional soundness of the component.
