  SECTION 651.1141. Immediate final orders.

  • 1(1) 2The Legislature finds that the following actions constitute an imminent and immediate threat to the public health, safety, and welfare of the residents of this state:
    28(a) 29The installation of a general partner of a provider or assumption of ownership or possession or control of 10 percent or more of a provider’s assets in violation of s. 59651.024 60or s. 62651.0245;
    63(b) 64The removal or commitment of 10 percent or more of the required minimum liquid reserve funds in violation of s. 84651.035; 85or
    86(c) 87The assumption of control over a facility’s operations in violation of s. 99651.043100.
    101(2) 102If it finds that a person or entity is engaging or has engaged in one or more of the above activities, the office may, pursuant to s. 129120.569, 130issue an immediate final order:
    135(a) 136Directing that such person or entity cease and desist that activity; or
    148(b) 149Suspending the certificate of authority of the facility.
