  SECTION 610.113. Nondiscrimination by municipality or county.

  • 1(1) 2A municipality or county shall allow a certificateholder to install, construct, and maintain a network within a public right-of-way and shall provide a certificateholder with comparable, nondiscriminatory, and competitively neutral access to the public right-of-way in accordance with the provisions of s. 44337.40145. All use of a public right-of-way by a certificateholder is nonexclusive.
    57(2) 58A municipality or county may not discriminate against a certificateholder regarding:
    69(a) 70The authorization or placement of a network in a public right-of-way;
    81(b) 82Access to a building or other property; or
    90(c) 91Utility pole attachment terms and conditions.
