  SECTION 61.533. Hearing and order.

  • 1(1) 2Unless the court enters a temporary emergency order under s. 1261.517, 13upon a finding that a petitioner is entitled to immediate physical custody of the child, the court shall order that the petitioner may take immediate physical custody of the child unless the respondent establishes that:
    48(a) 49The child custody determination has not been registered and confirmed under s. 6161.528 62and that:
    641. 65The issuing court did not have jurisdiction under ss. 7461.51475-7661.523;
    772. 78The child custody determination for which enforcement is sought has been vacated, stayed, or modified by a court of a state having jurisdiction to do so under ss. 10661.514107-10861.523; 109or
    1103. 111The respondent was entitled to notice, but notice was not given in accordance with the standards of s. 12961.509 130in the proceedings before the court that issued the order for which enforcement is sought; or
    146(b) 147The child custody determination for which enforcement is sought was registered and confirmed under s. 16261.528, 163but has been vacated, stayed, or modified by a court of a state having jurisdiction to do so under ss. 18361.514184-18561.523186.
    187(2) 188The court shall award the fees, costs, and expenses authorized under s. 20061.535 201and may grant additional relief, including a request for the assistance of law enforcement officers, and set a further hearing to determine whether additional relief is appropriate.
    228(3) 229If a party called to testify refuses to answer on the ground that the testimony may be self-incriminating, the court may draw an adverse inference from the refusal.
    257(4) 258A privilege against disclosure of communications between spouses and a defense of immunity based on the relationship of husband and wife or parent and child may not be invoked in a proceeding under ss. 29261.524293-29461.540295.
