SECTION 581.035. Preemption of regulatory authority over nurseries.

1It is the intent of the Legislature to eliminate duplication of regulatory authority over nurseries. Notwithstanding any other law to the contrary, the authority to regulate, inspect, and permit:
30(1) 31Nursery owners, plant brokers, and stock dealers; and
39(2) 40Nurseries, nursery stock, plants, and plant products, including any aquatic plant as defined in s. 55369.22 56which is grown in a nursery,
62is preempted to the department.
