  SECTION 531.50. Administrative fine, penalties, and offenses.

  • 1(1) 2The department may enter an order imposing one or more of the following penalties against a person who violates this chapter or any rule adopted under this chapter or impedes, obstructs, or hinders the department in performing its duties under this chapter:
    44(a) 45Issuance of a warning letter or notice.
    52(b) 53Imposition of an administrative fine in the Class II category pursuant to s. 66570.971 67for each violation.

    70When imposing any fine under this section, the department shall consider the degree and extent of potential harm caused by the violation, the amount of money by which the violator benefited from noncompliance, whether the violation was committed willfully, and the compliance record of the violator. All fines, monetary penalties, and costs received by the department shall be deposited in the General Inspection Trust Fund for the purpose of administering this chapter.

    142(2) 143Any person who willfully and knowingly violates any provision of this chapter or rule adopted by the department pursuant to this chapter commits a misdemeanor of the second degree, punishable as provided in s. 177775.082 178or s. 180775.083181. Upon a subsequent conviction, a person commits a misdemeanor of the first degree, punishable as provided in s. 200775.082 201or s. 203775.083204.
    205(3) 206No person shall:
    209(a) 210Use, or have in possession for use, in commerce any weight or measure not approved or corrected as provided in s. 231531.41(12)232.
    233(b) 234Use or dispose of any rejected or condemned weight or measure without specific authorization from the rejecting authority.
    252(c) 253Remove any mark of rejection from a rejected weight or measure without specific authorization from the rejecting authority.
