  SECTION 480.0535. Documents required while working in a massage establishment.

  • 1(1) 2In order to provide the department and law enforcement agencies the means to more effectively identify, investigate, and arrest persons engaging in human trafficking, a person employed by a massage establishment and any person performing massage therein must immediately present, upon the request of an investigator of the department or a law enforcement officer, valid government identification while in the establishment. A valid government identification for the purposes of this section is:
    74(a) 75A valid, unexpired driver license issued by any state, territory, or district of the United States;
    91(b) 92A valid, unexpired identification card issued by any state, territory, or district of the United States;
    108(c) 109A valid, unexpired United States passport;
    115(d) 116A naturalization certificate issued by the United States Department of Homeland Security;
    128(e) 129A valid, unexpired alien registration receipt card (green card); or
    139(f) 140A valid, unexpired employment authorization card issued by the United States Department of Homeland Security.
    155(2) 156A person operating a massage establishment must:
    163(a) 164Immediately present, upon the request of an investigator of the department or a law enforcement officer:
    1801. 181Valid government identification while in the establishment.
    1882. 189A copy of the documentation specified in paragraph (1)(a) for each employee and any person performing massage in the establishment.
    209(b) 210Ensure that each employee and any person performing massage in the massage establishment is able to immediately present, upon the request of an investigator of the department or a law enforcement officer, valid government identification while in the establishment.
    249(3) 250A person who violates any provision of this section commits:
    260(a) 261For a first violation, a misdemeanor of the second degree, punishable as provided in s. 276775.082 277or s. 279775.083280.
    281(b) 282For a second violation, a misdemeanor of the first degree, punishable as provided in s. 297775.082 298or s. 300775.083301.
    302(c) 303For a third or subsequent violation, a felony of the third degree, punishable as provided in s. 320775.082, 321s. 322775.083, 323or s. 325775.084326.
