  SECTION 408.820. Exemptions.

  • 1Except as prescribed in authorizing statutes, the following exemptions shall apply to specified requirements of this part:
    18(1) 19Laboratories authorized to perform testing under the Drug-Free Workplace Act, as provided under ss. 33112.0455 34and 35440.102, 36are exempt from s. 40408.810(5)41-(10).
    42(2) 43Birth centers, as provided under chapter 383, are exempt from s. 54408.810(7)55-(10).
    56(3) 57Abortion clinics, as provided under chapter 390, are exempt from s. 68408.810(7)69-(10).
    70(4) 71Crisis stabilization units, as provided under parts I and IV of chapter 394, are exempt from s. 88408.810(8)89-(10).
    90(5) 91Short-term residential treatment facilities, as provided under parts I and IV of chapter 394, are exempt from s. 109408.810(8)110-(10).
    111(6) 112Residential treatment facilities, as provided under part IV of chapter 394, are exempt from s. 127408.810(8)128-(10).
    129(7) 130Residential treatment centers for children and adolescents, as provided under part IV of chapter 394, are exempt from s. 149408.810(8)150-(10).
    151(8) 152Hospitals, as provided under part I of chapter 395, are exempt from s. 165408.810(7)166-(9).
    167(9) 168Ambulatory surgical centers, as provided under part I of chapter 395, are exempt from s. 183408.810(7)184-(10).

    335(18) 336Transitional living facilities, as provided under part XI of chapter 400, are exempt from s. 351408.810(10)352.
    353(19) 354Prescribed pediatric extended care centers, as provided under part VI of chapter 400, are exempt from s. 371408.810(10)372.
    373(20) 374Home medical equipment providers, as provided under part VII of chapter 400, are exempt from s. 390408.810(10)391.
    392(21) 393Intermediate care facilities for persons with developmental disabilities, as provided under part VIII of chapter 400, are exempt from s. 413408.810(7)414.
    415(22) 416Health care services pools, as provided under part IX of chapter 400, are exempt from s. 432408.810(6)433-(10).
    434(23) 435Health care clinics, as provided under part X of chapter 400, are exempt from s. 450408.810(6), 451(7), and (10).
    454(24) 455Organ, tissue, and eye procurement organizations, as provided under part V of chapter 765, are exempt from s. 473408.810(5)474-(10).
