SECTION 403.9331. Applicability; rules and policies.

1(1) 2The regulation of mangrove protection under ss. 9403.932110-11403.9333 12is intended to be complete and effective without reference to or compliance with other statutory provisions.
28(2) 29Any rule or policy applicable to permits provided for by s. 40403.9327 41or s. 43403.9328 44which establishes a standard applicable to mangrove trimming or alteration is invalid unless a scientific basis for the rule or policy is established. Such rules or policies shall not receive a presumption of validity in any administrative or judicial proceeding for review. Any such rule or policy must be demonstrated to substantially advance a fundamental purpose of the statute cited as authority for the rule or policy or shall be invalid.
