  SECTION 395.51. Confidentiality and quality assurance activities of trauma agencies.

  • 1(1) 2All information which is confidential by operation of law and which is obtained by a local or regional trauma agency or a panel or committee assembled by a local or regional trauma agency pursuant to s. 38395.50, 39shall retain its confidential status and be exempt from the provisions of s. 52119.07(1) 53and s. 24(a), Art. I of the State Constitution.
    62(2) 63All information which is confidential by operation of law and which is obtained by a hospital or emergency medical services provider from a local or regional trauma agency or a panel or committee assembled by a local or regional trauma agency pursuant to s. 107395.50, 108shall retain its confidential status and shall be exempt from the provisions of s. 122119.07(1) 123and s. 24(a), Art. I of the State Constitution.
    132(3) 133Portions of meetings, proceedings, reports, and records of a local or regional trauma agency, or a panel or committee assembled by a local or regional trauma agency pursuant to this chapter, which relate solely to patient care quality assurance are confidential and exempt from the provisions of s. 181286.011, 182and s. 24(b), Art. I of the State Constitution and are confidential and exempt from the provisions of s. 201119.07(1) 202and s. 24(a), Art. I of the State Constitution, respectively. Patient care quality assurance, for the purpose of this section, shall include consideration of specific persons, cases, incidents relevant to the performance of quality control, and system evaluation.
