  SECTION 288.92. Divisions of Enterprise Florida, Inc.

  • 1(1) 2Enterprise Florida, Inc., may create and dissolve divisions as necessary to carry out its mission. Each division shall have distinct responsibilities and complementary missions. At a minimum, Enterprise Florida, Inc., shall have divisions related to the following areas:
    40(a) 41International Trade and Business Development;
    46(b) 47Business Retention and Recruitment;
    51(c) 52Tourism Marketing;
    54(d) 55Minority Business Development; and
    59(e) 60Sports Industry Development.
    63(2)(a) 64The officers and agents of the divisions shall be hired and their annual compensation established by the president of Enterprise Florida, Inc., as deemed appropriate by the board of directors, and may be eligible for performance bonuses pursuant to s. 104288.905105. This paragraph does not apply to any employees of the corporation established pursuant to s. 121288.1226122.
    123(b)1. 124The following officers and board members are subject to ss. 134112.313(1)135-(8), (10), (12), and (15); 140112.3135; 141and 142112.3143(2)143:
    144a. 145Officers and members of the board of directors of the divisions of Enterprise Florida, Inc.
    160b. 161Officers and members of the board of directors of subsidiaries of Enterprise Florida, Inc.
    175c. 176Officers and members of the board of directors of corporations created to carry out the missions of Enterprise Florida, Inc.
    196d. 197Officers and members of the board of directors of corporations with which a division is required by law to contract to carry out its missions.
    2222. 223For purposes of applying ss. 228112.313(1)229-(8), (10), (12), and (15); 234112.3135; 235and 236112.3143(2) 237to activities of the officers and members of the board of directors specified in subparagraph 1., those persons shall be considered public officers or employees and the corporation shall be considered their agency.
    270(c) 271The board of directors of Enterprise Florida, Inc., may organize the divisions and, to the greatest extent possible, minimize costs by requiring that the divisions share administrative staff.
    299(3) 300Each division shall draft and submit an annual report for inclusion in the report required under s. 317288.906 318which details the division’s activities during the previous fiscal year and includes recommendations for improving current statutes related to the division’s area of responsibility.
