  SECTION 20.435. Department of Health; trust funds.

  • 1The following trust funds shall be administered by the Department of Health:
    13(1) 14Administrative Trust Fund.
    17(a) 18Funds to be credited to and uses of the trust fund shall be administered in accordance with s. 36215.3237.
    38(b) 39Notwithstanding the provisions of s. 44216.301 45and pursuant to s. 49216.351, 50any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    88(2) 89Federal Grants Trust Fund.
    93(a) 94Funds to be credited to the trust fund shall consist of grants and funding from the Federal Government and funds from the Medicaid program. Funds shall be used for the purposes of providing health and support services to department clients, supporting regulatory activities of the department, and funding disease surveillance and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the department’s operating budget pursuant to the provisions of chapter 216.
    178(b) 179Notwithstanding the provisions of s. 184216.301 185and pursuant to s. 189216.351, 190any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    228(3) 229Grants and Donations Trust Fund.
    234(a) 235Funds to be credited to the trust fund shall consist of restricted contractual revenue from public or private sources such as receipts from Medicaid, funds from federal environmental laws such as the Safe Drinking Water Act and the Superfund, funds from other health and environmental programs, and funds from private sources such as foundations. Funds shall be used for the purpose of supporting the activities of the department and shall be expended only pursuant to legislative appropriation or an approved amendment to the department’s operating budget pursuant to the provisions of chapter 216.
    328(b) 329Notwithstanding the provisions of s. 334216.301 335and pursuant to s. 339216.351, 340any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    378(4) 379Medical Quality Assurance Trust Fund.
    384(a) 385Funds to be credited to the trust fund shall consist of fees and fines related to the licensing of health care professionals. Funds shall be used for the purpose of providing administrative support for the regulation of health care professionals and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the department’s operating budget pursuant to the provisions of chapter 216.
    459(b) 460Notwithstanding the provisions of s. 465216.301 466and pursuant to s. 470216.351, 471any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    509(5) 510Social Services Block Grant Trust Fund.
    516(a) 517Funds to be credited to the trust fund shall consist of federal social services block grant funds. Funds shall be used for the purpose of providing health care and support services to department clients and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the department’s operating budget pursuant to the provisions of chapter 216.
    585(b) 586Notwithstanding the provisions of s. 591216.301 592and pursuant to s. 596216.351, 597any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    635(6) 636Tobacco Settlement Trust Fund.
    640(a) 641Funds to be credited to the trust fund shall consist of funds disbursed, by nonoperating transfer, from the Department of Financial Services Tobacco Settlement Clearing Trust Fund in amounts equal to the annual appropriations made from this trust fund.
    680(b) 681Notwithstanding the provisions of s. 686216.301 687and pursuant to s. 691216.351, 692any unencumbered balance in the trust fund at the end of any fiscal year and any encumbered balance remaining undisbursed on September 30 of the same calendar year shall revert to the Department of Financial Services Tobacco Settlement Clearing Trust Fund.
    733(7) 734Biomedical Research Trust Fund.
    738(a) 739Funds to be credited to the trust fund shall consist of funds deposited pursuant to s. 755215.5601 756and any other funds appropriated by the Legislature. Funds shall be used for the purposes of the James and Esther King Biomedical Research Program, the Florida Consortium of National Cancer Institute Centers Program, and the William G. “Bill” Bankhead, Jr., and David Coley Cancer Research Program as specified in ss. 806215.5602, 807288.955, 808381.915, 809and 810381.922811. The trust fund is exempt from the service charges imposed by s. 824215.20825.
    826(b) 827Notwithstanding the provisions of s. 832216.301 833and pursuant to s. 837216.351, 838any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund. The department may invest these funds independently through the Chief Financial Officer or may negotiate a trust agreement with the State Board of Administration for the investment management of any balance in the trust fund.
    911(c) 912Notwithstanding s. 914216.301 915and pursuant to s. 919216.351, 920any balance of any appropriation from the Biomedical Research Trust Fund which is not disbursed but which is obligated pursuant to contract or committed to be expended may be carried forward for up to 5 years following the effective date of the original appropriation.
    964(8) 965Welfare Transition Trust Fund.
    969(a) 970The Welfare Transition Trust Fund is created within the Department of Health for the purposes of receiving federal funds under the Temporary Assistance for Needy Families Program. Trust fund moneys shall be used exclusively for the purpose of providing services to individuals eligible for Temporary Assistance for Needy Families pursuant to the requirements and limitations of part A of Title IV of the Social Security Act, as amended, or any other applicable federal requirement or limitation. Funds credited to the trust fund consist of those funds collected from the Temporary Assistance for Needy Families Block Grant.
    1066(b) 1067Notwithstanding the provisions of s. 1072216.301 1073and pursuant to s. 1077216.351, 1078any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1116(9) 1117Brain and Spinal Cord Injury Program Trust Fund.
    1125(a) 1126Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of s. 1147381.791148.
    1149(b) 1150Notwithstanding the provisions of s. 1155216.301 1156and pursuant to s. 1160216.351, 1161any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1199(10) 1200County Health Department Trust Fund.
    1205(a) 1206Funds to be credited to and uses of the trust fund shall be administered in accordance with s. 1224154.021225.
    1226(b) 1227Notwithstanding the provisions of s. 1232216.301 1233and pursuant to s. 1237216.351, 1238any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1276(11) 1277Donations Trust Fund.
    1280(a) 1281Funds to be credited to the trust fund shall consist of state and federal grant funds and fees collected and shall be used for the purpose of providing health care and support services to department clients and for other such purposes as may be appropriate.
    1326(b) 1327Notwithstanding the provisions of s. 1332216.301 1333and pursuant to s. 1337216.351, 1338any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1376(12) 1377Emergency Medical Services Trust Fund.
    1382(a) 1383Funds to be credited to and uses of the trust fund shall be administered in accordance with ss. 1401318.14, 1402318.18, 1403318.21, 1404395.403, 1405and 1406395.4036 1407and parts I and II of chapter 401.
    1415(b) 1416Notwithstanding the provisions of s. 1421216.301 1422and pursuant to s. 1426216.351, 1427any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1465(13) 1466Epilepsy Services Trust Fund.
    1470(a) 1471Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of s. 1492385.2071493.
    1494(b) 1495Notwithstanding the provisions of s. 1500216.301 1501and pursuant to s. 1505216.351, 1506any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1544(14) 1545Maternal and Child Health Block Grant Trust Fund.
    1553(a) 1554Funds to be credited to the trust fund shall consist of federal maternal and child block grant funds and shall be used for the purpose of providing health care and support services to department clients and for other such purposes as may be appropriate.
    1598(b) 1599Notwithstanding the provisions of s. 1604216.301 1605and pursuant to s. 1609216.351, 1610any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1648(15) 1649Planning and Evaluation Trust Fund.
    1654(a) 1655Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of ss. 1676381.0202 1677and 1678382.02551679.
    1680(b) 1681Notwithstanding the provisions of s. 1686216.301 1687and pursuant to s. 1691216.351, 1692any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1730(16) 1731Preventive Health Services Block Grant Trust Fund.
    1738(a) 1739Funds to be credited to the trust fund shall consist of federal preventive health services block grant funds and shall be used for the purpose of providing health care and support services to department clients and for other such purposes as may be appropriate.
    1783(b) 1784Notwithstanding the provisions of s. 1789216.301 1790and pursuant to s. 1794216.351, 1795any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1833(17) 1834Radiation Protection Trust Fund.
    1838(a) 1839Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of chapter 404 and part IV of chapter 468.
    1867(b) 1868Notwithstanding the provisions of s. 1873216.301 1874and pursuant to s. 1878216.351, 1879any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1917(18) 1918Rape Crisis Program Trust Fund.
    1923(a) 1924Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of s. 1945794.0561946.
    1947(b) 1948Notwithstanding the provisions of s. 1953216.301 1954and pursuant to s. 1958216.351, 1959any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
    1997(19) 1998United States Trust Fund.
    2002(a) 2003Funds to be credited to the trust fund shall consist of federal funds from the Social Security Administration and shall be used for the purpose of determining the eligibility of Florida citizens applying for disability benefits under the federal Social Security and Supplemental Security Income Programs.
    2049(b) 2050Notwithstanding the provisions of s. 2055216.301 2056and pursuant to s. 2060216.351, 2061any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
