SECTION 20.425. Agency for Health Care Administration; trust funds.

1The following trust funds shall be administered by the Agency for Health Care Administration:
15(1) 16Administrative Trust Fund.
19(a) 20Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of s. 41215.3242.
43(b) 44Notwithstanding the provisions of s. 49216.30150and pursuant to s. 54216.351, 55any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
93(2) 94Grants and Donations Trust Fund.
99(a) 100Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of ss. 121215.32, 122400.179, 123and 124409.916125.
126(b) 127Notwithstanding the provisions of s. 132216.301133and pursuant to s. 137216.351, 138any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
176(3) 177Health Care Trust Fund.
181(a) 182Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of ss. 203400.063204and 205408.16206.
207(b) 208Notwithstanding the provisions of s. 213216.301214and pursuant to s. 218216.351, 219any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
257(4) 258Medical Care Trust Fund.
262(a) 263Funds to be credited to the trust fund shall consist of receipts from federal grants and shall be used for the purpose of providing health care services to individuals eligible pursuant to the requirement and limitation of Titles XIX and XXI of the Social Security Act, as amended, and for other such purposes as may be appropriate.
320(b) 321Notwithstanding the provisions of s. 326216.301327and pursuant to s. 331216.351, 332any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
370(5) 371Public Medical Assistance Trust Fund.
376(a) 377Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of ss. 398394.4786399and 400409.918401.
402(b) 403Notwithstanding the provisions of s. 408216.301409and pursuant to s. 413216.351, 414any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
452(6) 453Quality of Long-Term Care Facility Improvement Trust Fund.
461(a) 462Funds to be credited to and uses of the trust fund shall be administered in accordance with the provisions of s. 483400.0239484.
485(b) 486Notwithstanding the provisions of s. 491216.301492and pursuant to s. 496216.351, 497any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
535(7) 536Refugee Assistance Trust Fund.
540(a) 541Funds to be credited to the trust fund shall consist of federal grant funds under the Refugee Resettlement Program and the Cuban/Haitian Entrant Program and shall be used for the purpose of providing medical assistance to individuals eligible pursuant to the requirements and limitations of 45 C.F.R. parts 400 and 401, as amended, or any other applicable federal requirement or limitation.
602(b) 603Notwithstanding the provisions of s. 608216.301609and pursuant to s. 613216.351, 614any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
652(8) 653Tobacco Settlement Trust Fund.
657(a) 658Funds to be credited to the trust fund shall consist of funds disbursed, by nonoperating transfer, from the Department of Financial Services Tobacco Settlement Clearing Trust Fund in amounts equal to the annual appropriations made from this trust fund.
697(b) 698Notwithstanding the provisions of s. 703216.301704and pursuant to s. 708216.351, 709any unencumbered balance in the trust fund at the end of any fiscal year and any encumbered balance remaining undisbursed on September 30 of the same calendar year shall revert to the Department of Financial Services Tobacco Settlement Clearing Trust Fund.
