SECTION 20.415. Department of Elderly Affairs; trust funds.

1The following trust funds shall be administered by the Department of Elderly Affairs:
14(1) 15Administrative Trust Fund.
18(a) 19Funds to be credited to and uses of the trust fund shall be administered in accordance with ss. 37215.32, 38744.534, 39and 40744.200141.
42(b) 43Notwithstanding the provisions of s. 48216.30149and pursuant to s. 53216.351, 54any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
92(2) 93Tobacco Settlement Trust Fund.
97(a) 98Funds to be credited to the trust fund shall consist of funds disbursed, by nonoperating transfer, from the Department of Financial Services Tobacco Settlement Clearing Trust Fund in amounts equal to the annual appropriations made from this trust fund.
137(b) 138Notwithstanding the provisions of s. 143216.301144and pursuant to s. 148216.351, 149any unencumbered balance in the trust fund at the end of any fiscal year and any encumbered balance remaining undisbursed on September 30 of the same calendar year shall revert to the Department of Financial Services Tobacco Settlement Clearing Trust Fund.
190(3) 191Federal Grants Trust Fund.
195(a) 196Funds to be credited to and uses of the trust fund shall be administered in accordance with s. 214215.32215.
216(b) 217Notwithstanding the provisions of s. 222216.301223and pursuant to s. 227216.351, 228any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
266(4) 267Grants and Donations Trust Fund.
272(a) 273Funds to be credited to the trust fund shall include all public and private grants and donations to the department, except for grants provided by the Federal Government and other earnings that are deposited into the Operations and Maintenance Trust Fund of the department. Funds from the Grants and Donations Trust Fund shall be used to fulfill agreements made with grantors and contributors and such other purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the department’s operating budget pursuant to chapter 216.
366(b) 367Notwithstanding the provisions of s. 372216.301373and pursuant to s. 377216.351, 378any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
416(c) 417Notwithstanding the provisions of s. 422216.301423and pursuant to s. 427216.351, 428any balance of any general revenue appropriation to the Grants and Donations Trust Fund that is not disbursed but that is obligated pursuant to contract or committed to be expended may be certified by the Governor for up to 3 years following the effective date of the original appropriation.
477(5) 478Operations and Maintenance Trust Fund.
483(a) 484Funds to be credited to and uses of the trust fund shall be administered in accordance with s. 502215.32503.
504(b) 505Notwithstanding the provisions of s. 510216.301511and pursuant to s. 515216.351, 516any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
