SECTION 20.1971. Agency for Persons with Disabilities; trust funds.

1The following trust funds shall be administered by the Agency for Persons with Disabilities:
15(1) 16The Administrative Trust Fund.
20(a) 21Funds to be credited to the trust fund shall consist of federal matching funds provided for the administration of Medicaid services. Funds shall be used for the purpose of supporting the agency’s administration of Medicaid programs and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the agency’s operating budget pursuant to the provisions of chapter 216.
91(b) 92Notwithstanding the provisions of s. 97216.30198and pursuant to s. 102216.351, 103any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
141(2) 142The Operations and Maintenance Trust Fund.
148(a) 149Funds to be credited to the trust fund shall consist of receipts from third-party payors of health care services such as Medicaid. Funds shall be used for the purpose of providing health care services to agency clients and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the agency’s operating budget pursuant to the provisions of chapter 216.
220(b) 221Notwithstanding the provisions of s. 226216.301227and pursuant to s. 231216.351, 232any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
270(3) 271The Social Services Block Grant Trust Fund.
278(a) 279Funds to be credited to the trust fund shall consist of federal social services block grant funds. These shall be used for the purpose of providing health care and support services to agency clients and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the agency’s operating budget pursuant to the provisions of chapter 216.
347(b) 348Notwithstanding the provisions of s. 353216.301354and pursuant to s. 358216.351, 359any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
397(4) 398The Tobacco Settlement Trust Fund.
403(a) 404Funds to be credited to the trust fund shall consist of funds disbursed, by nonoperating transfer, from the Department of Financial Services Tobacco Settlement Clearing Trust Fund in amounts equal to the annual appropriations made from this trust fund.
443(b) 444Notwithstanding the provisions of s. 449216.301450and pursuant to s. 454216.351, 455any unencumbered balance in the trust fund at the end of any fiscal year and any encumbered balance remaining undisbursed on September 30 of the same calendar year shall revert to the Department of Financial Services Tobacco Settlement Clearing Trust Fund.
496(5) 497The Federal Grants Trust Fund.
502(a) 503Funds to be credited to the trust fund shall consist of receipts from federal grants. Funds shall be used for the purpose of providing health care services to agency clients and for other such purposes as may be appropriate and shall be expended only pursuant to legislative appropriation or an approved amendment to the agency’s operating budget pursuant to the provisions of chapter 216.
567(b) 568Notwithstanding the provisions of s. 573216.301574and pursuant to s. 578216.351, 579any balance in the trust fund at the end of any fiscal year shall remain in the trust fund at the end of the year and shall be available for carrying out the purposes of the trust fund.
