SECTION 142.01. Fine and forfeiture fund; disposition of revenue; clerk of the circuit court.

  • 1(1) 2There shall be established by the clerk of the circuit court in each county of this state a separate fund to be known as the fine and forfeiture fund for use by the clerk of the circuit court in performing court-related functions. The fund shall consist of the following:
    51(a) 52Fines and penalties pursuant to ss. 5828.2402(2), 5934.045(2), 60316.193, 61327.35, 62327.72, 63379.2203(1), 64and 65775.083(1)66.
    67(b) 68That portion of civil penalties directed to this fund pursuant to s. 80318.2181.
    82(c) 83Court costs pursuant to ss. 8828.2402(1)(b), 8934.045(1)(b), 90318.14(10)(b), 91318.18(11)(a), 92327.73(9)(a) 93and (11)(a), and 96938.05(3)97.
    98(d) 99Proceeds from forfeited bail bonds, unclaimed bonds, unclaimed moneys, or recognizances pursuant to ss. 113321.05(4)(a), 114379.2203(1), 115and 116903.26(3)(a)117.
    118(e) 119Fines and forfeitures pursuant to s. 12534.191126.
    127(f) 128Filing fees received pursuant to ss. 13428.241 135and 13634.041, 137unless the disposition of such fees is otherwise required by law.
    148(g) 149All other revenues received by the clerk as revenue authorized by law to be retained by the clerk.
    167(2) 168Notwithstanding this section, all fines and forfeitures arising from operation of s. 180318.1215 181shall be disbursed in accordance with that section.
