  SECTION 1002.321. Digital learning.

    15(2) 16ELEMENTS OF HIGH-QUALITY DIGITAL LEARNING.21-22The Legislature finds that each student should have access to a high-quality digital learning environment that provides:
    39(a) 40Access to digital learning.
    44(b) 45Access to high-quality digital content and online courses.
    53(c) 54Education that is customized to the needs of the student using digital content.
    67(d) 68A means for the student to demonstrate competency in completed coursework.
    79(e) 80High-quality digital content, instructional materials, and online and blended learning courses.
    91(f) 92High-quality digital instruction and teachers.
    97(g) 98Content and instruction that are evaluated on the metric of student learning.
    110(h) 111The use of funding as an incentive for performance, options, and innovation.
    123(i) 124Infrastructure that supports digital learning.
    129(j) 130Online administration of state assessments.
    135(3) 136DIGITAL PREPARATION.138-139As required under s. 1431003.4282, 144a student entering grade 9 in the 2011-2012 school year and thereafter who seeks a high school diploma must take at least one online course.
    169(4) 170CUSTOMIZED AND ACCELERATED LEARNING.174-175A school district must establish multiple opportunities for student participation in part-time and full-time kindergarten through grade 12 virtual instruction. Options include, but are not limited to:
    202(a) 203School district operated part-time or full-time virtual instruction programs under s. 2141002.45(1)(b) 215for kindergarten through grade 12 students enrolled in the school district. A full-time program shall operate under its own Master School Identification Number.
    238(b) 239Florida Virtual School instructional services authorized under s. 2471002.37248.
    249(c) 250Blended learning instruction provided by charter schools authorized under s. 2601002.33261.
    262(d) 263Full-time virtual charter school instruction authorized under s. 2711002.33272.
    273(e) 274Courses delivered in the traditional school setting by personnel providing direct instruction through virtual instruction or through blended learning courses consisting of both traditional classroom and online instructional techniques pursuant to s. 3061003.498307.
    308(f) 309Virtual courses offered in the course code directory to students within the school district or to students in other school districts throughout the state pursuant to s. 3361003.498337.
    338(5) 339INTEGRITY OF ONLINE COURSES.343-344It is unlawful for any person to knowingly and willfully take an online course or examination on behalf of another person for compensation. Any person who violates this subsection commits a misdemeanor of the second degree, punishable as provided in s. 385775.082 386or s. 388775.083389.
    390(6) 391ONLINE CATALOG.393-394The department shall develop an online catalog of available digital learning courses provided pursuant to ss. 4101002.37, 4111002.45, 4121003.498, 413and 4141003.499, 415which provides, for each course, access to the course description, completion and passage rates, and a method for student and teacher users to provide evaluative feedback.
